East Hampton Police Reports for the Week of July 31

MONTAUK — Karlie Mekalani Thoma, 27, who lives for most of the year in Maui but works in Montauk during the summer season, was arrested by East Hampton Town Police around daybreak on July 23 on a felony charge of criminal mischief in the second degree, along with a misdemeanor charge of obstruction of breathing. According to police, Thoma and another woman got into a heated altercation, during which the other woman grabbed Thoma’s phone, police were told. In response, police said, Thoma grabbed the other woman’s iPhone 16 Pro, went outside the house they were staying in, and smashed it on the pavement on South Essex Street. The other woman ran out after Thoma and recovered her phone, returning back inside, followed by Thoma, when the altercation turned physical, police said, with Thoma pinning the other woman to the ground, pressing her knee onto the woman’s throat, and grabbing the phone back. According to the police, Thoma went back outside with the phone and repeatedly smashed it onto the pavement, before returning and destroying an Apple laptop belonging to the other woman. Police estimated the total cost of damages at about $3,200, well over the $1,500 cost that triggers the D felony criminal mischief charge. A temporary order of protection was issued later that morning by East Hampton Town Justice David Filer on behalf of the alleged victim.

SPRINGS — East Hampton Town Police arrested Anthony Cabrera, 21, of Springs on two misdemeanor charges of assault in the third degree on Sunday afternoon. The incidents occurred the evening of July 21. According to police, over the course of several hours, Cabrera bit the alleged victim, then later struck and grabbed her in a violent manner, causing various injuries. A stay-away order of protection was issued Monday morning by East Hampton Town Justice Steven Tekulsky on behalf of the victim against Cabrera during his arraignment.

EAST HAMPTON — A head-on collision on Three Mile Harbor Road the night of July 21 led to the arrest by Town Police of Fabian M. Montaleza, 50, of East Hampton on a misdemeanor DWI charge. Police said Montaleza was driving a southbound 2016 Hyundai sedan when he crossed over into the northbound lane, colliding with a 2002 Toyota sedan, “causing substantial damage to both vehicles,” the report reads. Montaleza appeared intoxicated and failed sobriety tests, leading to his arrest. Montaleza, who had no passengers in his vehicle, and the driver and passenger of the Toyota all were taken to the Stony Brook Southampton Hospital’s new emergency unit in East Hampton with non-life-threatening injuries in separate ambulances, with an officer accompanying Montaleza, after placing him under arrest. At the facility, Montaleza agreed to have blood drawn to determine the level of alcohol in his system. He was released with an appearance ticket, which called for him to be arraigned yesterday in East Hampton. In addition to the DWI charge, a misdemeanor unlicensed operation of a motor vehicle charge was added onto his docket. Police said his license has already been suspended three times over, including one alcohol-related suspension.

EAST HAMPTON — Town officers responding to a reported off-road crash on Middle Highway the evening of July 22 reported seeing Steven J. Lavay, 26, of East Hampton running away from a wrecked 2010 Ford pick-up, which had crashed into a tree. Police reported pursuing Lavay, soon catching up with him. He appeared intoxicated, and failed sobriety tests, police said, and was charged with misdemeanor DWI. At headquarters, a breath test produced a reading of .12, exceeding the .08 mark that defines intoxication in New York State.

AMAGANSETT — Town Police were tipped off by a pedestrian that there was a vehicle stopped in the roadway on Hedges Lane, engine running, early Saturday morning. The investigating officer reported finding Andrew J. Fenet, 44, a Manhattan resident who also owns a house in Amagansett, asleep behind the wheel of a 2019 Land Rover, which, the officer said, was impeding traffic. Police said Fenet appeared intoxicated and failed the sobriety tests he participated in, while refusing to participate in a couple of the tests. According to police, Fenet told the officer that he had not been operating the vehicle, since he was asleep, and had the engine on to run the air conditioning on a hot and muggy night. Fenet was placed under arrest on a misdemeanor DWI charge. At headquarters, he refused to take a breath test, leading Justice Steven Tekulsky later that morning during Fenet’s arraignment to suspend his New York driver’s license for the next year, pending a hearing at the DMV.

EAST HAMPTON — Town Police arrested Luis G. Lupercio Pugo, 38, of Springs on misdemeanor DWI charges early morning July 20. Driving a 2014 Ford, Lupercio Pugo was pulled over after turning onto Springs Fireplace Road without signaling, as well as swerving over the double yellow lines multiple times, police said. Failing sobriety tests, he was arrested and taken to headquarters, where a breath test exceeded the .08 mark that defines intoxication in New York.
